1. Introduction

Welcome to Digiorder, a trading name of Digiorder ltd ("Service", "we", "our", "us"). By subscribing to and using our service, you agree to comply with these Terms and Conditions. If you do not agree, you should not use our service.

2. Service Description
We provide a direct ordering system for restaurants and takeaways, enabling customers to place orders directly with the restaurant. We do not act as an intermediary, marketplace, or platform; we simply provide the technology for restaurants to manage orders.

3. Subscription and Payment

Our service is provided on a subscription basis.

The subscription fee is outlined at the time of purchase and is payable in advance.

We reserve the right to change the subscription price with 14 days' prior written notice. It is your responsibility to ensure that the service remains suitable for your needs.

Failure to pay the subscription fee may result in suspension or termination of your account.

4. User Responsibilities
For Restaurants:

You are responsible for ensuring your business complies with all local laws and regulations regarding food safety, order fulfillment, and consumer protection.

You are responsible for maintaining the accuracy of your menu, pricing, and availability.

You must not use our service for any illegal or unauthorized purposes.

You are responsible for fulfilling customer orders accurately and in a timely manner.

For Customers:

You acknowledge that orders placed through our system are made directly with the restaurant and not with Digiorder.

You must provide accurate delivery and contact information when placing an order.

Any disputes regarding order fulfillment, food quality, or refunds must be resolved directly with the restaurant.

5. Refunds and Cancellations

Subscriptions are non-refundable unless required by law.

You may cancel your subscription at any time, but no refunds will be issued for unused portions of the subscription period.

Customers should contact the restaurant directly for order cancellations or refunds, subject to the restaurant's policy.

6. Limitation of Liability

We provide our service "as is" and make no warranties regarding uptime, availability, or fitness for a particular purpose.

We are not responsible for any loss of revenue, data, or reputation arising from your use of our service.

We are not liable for disputes between restaurants and customers regarding order accuracy, quality, or fulfillment.

Our liability is limited to the amount paid by you in the preceding three months.

7. Termination

We reserve the right to terminate your subscription at our discretion, with or without cause, including for non-payment or misuse of the service.

8. Changes to These Terms

We may update these terms from time to time and will notify you of significant changes. Continued use of the service constitutes acceptance of the updated terms.

9. Governing Law

These terms are governed by the laws of the United Kingdom.
